Gangs wreck Ōtara woman’s tenancy

Oracle Property Management applied to the Tenancy Tribunal for termination of Antoinette Christine Wade’s tenancy after neighbours complained they felt traumatised, intimidated and unsafe in their homes.

Several witnessed the shooting and are now police witnesses. The police have also been involved in other incidents at Wade’s property.

Three notices of anti-social behaviour were issued by Oracle Property Management to Wade on successive days after the shooting. The other two notices related to gang activity, drug and alcohol use, fighting in the street, motorbikes and cars turning up and racing up the driveway.

The landlord gave the tribunal emails and documentation relating to the three notices and the effect the behaviour had on neighbours.

Wade, who was extremely remorseful, apologised and accepted the neighbours were traumatised. She said the boarder was the cause of the issues and antisocial behaviour at the property.

She told the tribunal she felt overpowered and intimidated by him and that she had lost control of the situation. Whenever she would complain to the boarder about the problems he would shrug his shoulders and tell her that it was his domain now.

Some visitors to the property were in gang regalia and there were a number of motorbikes and cars going up and down the driveway.

The boarder is now in prison because of the shooting. During the tribunal hearing Wade said she had decided to move out of the property but she does not want him to know where she is when he is released from prison. She is afraid there could be retaliation for her co-operating with the police.

The move was also related, she said, to the shame she felt, awareness of the bad feelings the neighbours had about her and the fact she now stays in her house to avoid the neighbours. She has been seeking assistance from her iwi and social and emergency housing agencies.

While she has agreed to move and set a date with the landlord, the tribunal still issued an order terminating the tenancy as Oracle Property Management had proven its case.

The tribunal says it appreciated the complete openness and honesty of the tenant.

“She has agreed to work with the landlord to bring the tenancy to an end and the landlord has agreed to assist the tenant any way they can. Until the boarder come to live at the property, the tenant had been a good tenant.”
